MCLE : The New Massachusetts Transgender Equal Rights Law: Strategies for compliance and advocacy

On November 23, 2011, Massachusetts Governor Deval Patrick signed into law "An Act Relative to Transgender Equal Rights." The new law, effective July 1, 2012, prohibits discrimination on the basis of "gender identity" in employment, education, housing, credit, and lending and makes violence against transgender individuals a hate crime. The new law is to be enforced by the Massachusetts Commission Against Discrimination (MCAD). This program educates practitioners about the new law, from both a compliance and advocacy standpoint.

You will learn...

  • What the term "gender identity" means, and how it differs from gender or sexual orientation
  • About the history and purpose of the new transgender rights law, as well as legal protections currently in place under federal and state law
  • How the MCAD handles claims of transgender discrimination, both now and once the new law goes into effect
  • About steps that employers, landlords, lenders, and others subject to the law can take to come into compliance with the new law and prevent legal claims for gender identity discrimination
  • About the "Do's and Don'ts" of representing transgender individuals, including legal theories, informed and sensitive communication with transgender clients, and available resources
  • What the future may hold for transgender rights
